Colorado AI Act Enforcement Is Paused. That Does Not Mean You Can Stop Preparing.

On April 27, 2026, a federal court granted a stay of enforcement for Colorado's landmark AI Act (SB24-205), just weeks before its anticipated June 30 effective date. The ruling came after xAI filed suit challenging the law, and the Department of Justice intervened in the case.

For compliance officers at credit unions, insurance carriers, and enterprise organizations operating in Colorado, the immediate reaction might be relief. But that relief should be temporary, because the compliance clock has not actually stopped.

Why the Pause Changes Less Than You Think

The court order prevents the Colorado Attorney General from initiating enforcement actions while the litigation plays out. It does not repeal the law. It does not eliminate the underlying requirements. And it does not change the trajectory of AI regulation across the United States.

Connecticut is advancing Senate Bill 5, one of the most comprehensive omnibus AI governance bills in the country. California's AB 2013 training data transparency requirements took effect on January 1, 2026. At least a dozen other states have active AI legislation moving through committees right now. The federal government has signaled interest in a national AI policy framework, but preemption remains uncertain.

Organizations that treat the Colorado pause as permission to shelve their AI governance programs will find themselves scrambling when enforcement resumes, or when the next state law takes effect.

What Colorado SB24-205 Actually Requires

Even in its paused state, the law's requirements offer a useful blueprint for what regulators across the country expect from organizations that deploy high-risk AI systems. The core obligations include establishing a risk management policy aligned with the NIST AI Risk Management Framework or an equivalent recognized standard, conducting impact assessments within 90 days of the effective date and annually thereafter, documenting how AI systems are used in consequential decisions, and providing notice to consumers when AI materially influences decisions about them.

These are not exotic requirements. They reflect the direction that AI governance is heading nationally and internationally, from the EU AI Act's sandbox provisions taking shape by August 2026 to the NCUA's updated AI resource hub guiding credit union examiners.

The Real Risk of Waiting

For credit union compliance teams, the NCUA has made clear that AI risk should be embedded within existing risk and compliance frameworks. Examiners are already benchmarking how credit unions govern AI solutions and manage associated risks. Waiting for Colorado's enforcement to resume before building those governance structures means falling behind what regulators expect today.

Insurance underwriters face similar pressure. Algorithmic discrimination in underwriting decisions carries fair lending and consumer protection exposure regardless of whether a specific state AI law is in effect. The legal theories that support enforcement actions against biased AI systems existed long before SB24-205 was drafted.

Enterprise procurement teams evaluating AI vendors need documented evidence of how those vendors manage model risk, data quality, and bias. That due diligence obligation does not pause when a court issues a stay.

What to Do Right Now

Organizations that have not started should begin with three practical steps.

First, build an AI inventory. You cannot govern what you have not cataloged. Document every AI system in use across your organization, including third-party tools embedded in vendor platforms. Identify which systems influence consequential decisions about consumers, employees, or members.

Second, adopt a risk framework. The NIST AI Risk Management Framework provides a solid foundation, and Colorado's law explicitly references it as a benchmark. Aligning to NIST now means your governance program will be portable across whatever state or federal requirements emerge next.

Third, establish a transparency baseline. Understand what your AI systems do, what data they use, and how they reach decisions. The Window Is Open, Not Closed

The enforcement pause is not a reprieve. It is a window. Organizations that use this time to build their AI governance foundations will be positioned to demonstrate compliance when enforcement resumes, and will be ahead of the curve when the next regulation arrives.

The organizations that wait will be the ones explaining to their boards why they need an emergency budget for a compliance program they should have started building months ago.
